Criminal Procedure Code, 1973—Section 438 – Anticipatory bail – Rape – Granted – Accused practicing advocate – Delay of 28 days in FIR – Medical report not supporting prosecution – Same complainant earlier also filed rape complaint against other advocate in which police has filed ‘B’ summary report which was accepted by concerned Court – Fit case for exercise of discretion in favour of petitioner. Anticipatory bail granted.
